Sponsor Eligibility Requirements

To be eligible to sponsor you must:

Be 18 years or older
Be a Canadian citizen or permanent resident
Be residing in Canada (or intend to return if citizen living abroad)
Not be receiving social assistance (except disability)
Not be under a removal order
Not have a previous sponsorship in default
Not have been convicted of certain violent or sexual offences
Not be bankrupt (for PGP only)

Who Qualifies as a Sponsored Partner?

Legally Married Spouse

  • ✓ Valid legal marriage recognized by the country where it took place AND by Canadian law
  • ✓ Cannot be a proxy marriage
  • ✓ Cannot currently be married to someone else (polygamous marriages not recognized)

Common-Law Partner

  • ✓ Has cohabited in a conjugal relationship for at least 12 continuous months
  • ✓ Must provide substantial evidence of cohabitation
  • ✓ Evidence: joint lease, bills, bank accounts, correspondence

Evidence package is critical — this is where many applications fail.

Conjugal Partner

  • ✓ In a genuine relationship of at least 1 year
  • ✓ Could not cohabit due to exceptional circumstances (immigration barrier, legal, religious)
  • ✓ Highest evidence burden of the three categories

Building Your Relationship Evidence Package

This is the most critical part of any spousal sponsorship — especially for common-law applicants.

Financial Ties

Examples: Joint bank accounts, shared expenses, financial support records, insurance as beneficiaries

Communication Records

Examples: Text messages, emails, video call records, letters, social media messages

Photos & Social Life

Examples: Photos together over time, social events, family gatherings, travel together

Official Documents

Examples: Joint lease or mortgage, shared address on IDs, wedding certificates, marriage registration

Statutory Declarations

Examples: Declarations from family, friends, religious leaders confirming the relationship

Travel History

Examples: Visits to each other, travel together, entry stamps, tickets and hotel records

Spousal Open Work Permit (BOWP)

Inland applicants can apply for a Bridging Open Work Permit while their PR is processing.

If your spouse or partner is already in Canada on a valid temporary status and you submit an inland spousal sponsorship, they can apply for an open work permit called a BOWP (Bridging Open Work Permit).

This allows them to work for any employer in Canada while waiting for their PR — maintaining their status and income.
