Who Qualifies as a Sponsored Partner?
Legally Married Spouse
- ✓ Valid legal marriage recognized by the country where it took place AND by Canadian law
- ✓ Cannot be a proxy marriage
- ✓ Cannot currently be married to someone else (polygamous marriages not recognized)
Common-Law Partner
- ✓ Has cohabited in a conjugal relationship for at least 12 continuous months
- ✓ Must provide substantial evidence of cohabitation
- ✓ Evidence: joint lease, bills, bank accounts, correspondence

Conjugal Partner
- ✓ In a genuine relationship of at least 1 year
- ✓ Could not cohabit due to exceptional circumstances (immigration barrier, legal, religious)
- ✓ Highest evidence burden of the three categories

Spousal Open Work Permit (BOWP)
Inland applicants can apply for a Bridging Open Work Permit while their PR is processing.
If your spouse or partner is already in Canada on a valid temporary status and you submit an inland spousal sponsorship, they can apply for an open work permit called a BOWP (Bridging Open Work Permit).
This allows them to work for any employer in Canada while waiting for their PR — maintaining their status and income.
